These terms apply to all quotes and projects of KA Beheer, trading as Crafted by KA. This way you know exactly where you stand. In case of differences, the Dutch version prevails.
Contractor: KA Beheer (sole proprietorship), trading as Crafted by KA., Chamber of Commerce 89999568. Client: the person or business requesting a quote or giving an assignment. Work: everything the contractor creates, such as designs, copy, code and websites.
These terms apply to every quote, assignment and agreement. Deviations only apply when agreed in writing (email counts). The client’s own terms do not apply.
The free design is a design of one homepage. It is free and without obligation.
The design remains the property of the contractor until you place an order. Without an order you may not build or use the design, also not through someone else.
The contractor may decide whether to take on a request.
A quote is valid for 30 days and describes what will be made, the planning and the price. An assignment starts as soon as you accept the quote in writing or by email.
All prices for business clients exclude VAT unless stated otherwise.
The contractor carries out the work carefully and to the best of their ability. You provide the copy, images and access needed on time.
The quote states how many feedback rounds are included. Anything beyond the agreement is extra work, which we always discuss before it is charged.
A delivery date is a target date. If it shifts, you will hear about it as soon as possible.
A 50% deposit may be requested at the start of a project. Invoices are due within 14 days of the invoice date.
If payment is late, you first receive a reminder. If payment still does not follow, statutory (commercial) interest is due and reasonable collection costs may be charged as allowed by law. Work may be paused until payment.
After full payment you may use the delivered work without limits for your own business. Your domain and accounts are in your name where possible, and you can always have everything transferred.
The contractor may show the work in their portfolio unless agreed otherwise.
Third-party software, fonts and images fall under the licences of those parties.
Hosting and maintenance run monthly or yearly as stated in the quote. You can cancel with one month’s notice. After cancelling I will help you move the website.
The contractor is only liable for direct damage resulting from an attributable failure. Liability is limited to the invoice amount of the assignment, or for ongoing services to the fees of the last 3 months.
The contractor is not liable for indirect damage, such as lost revenue, or for outages at hosting providers and other third parties. This limitation does not apply in case of intent or gross negligence.
In case of force majeure, such as illness or outages beyond my control, obligations are suspended. If it lasts longer than 60 days, either of us may end the assignment in writing. Work already done is settled proportionally.
Not satisfied? Let me know within 14 days of delivery via kingsley@kaholding.nl and we will find a solution together.
If you are a consumer rather than a business, you have a 14-day cooling-off period after the agreement. If you ask me to start within those 14 days and then withdraw, you pay proportionally for work already done. Statutory consumer rights always apply.
Dutch law applies to all agreements. Disputes we cannot resolve together are submitted to the competent court in the district of Gelderland.
